South Africa’s highest court has ruled that husbands can legally take their wife’s surname, striking down a law that only allowed women to adopt their husband's name. The court described the old rule as a colonial import that promoted gender inequality.
The case was brought by two married couples who argued the law was outdated and unfair. The court agreed, stating that the law violated the constitutional right to equality. In many African traditions, women kept their birth names after marriage, and children often used their mother’s clan name. But these practices changed under colonial rule and Western influence.
The court explained that this naming tradition came from Roman-Dutch law and was introduced during the colonial period. It added that while South Africa has made progress in gender equality, some laws still reflect harmful stereotypes. Parliament must now change the official registration laws to match the court’s decision. Even government officials and legal experts agreed that the old law no longer reflects modern values.
